Creating a good specification requires experience and intuition. The specifics of the specification will vary depending on the person in charge, based on the content of the invention discussed. We emphasize two key points when drafting specifications: (1) “What are the optimal claims?” and (2) “Is there sufficient backup for the claims?”
In (1), we strive to construct a claim tree by considering the highest-level claim as a concept claim, followed by medium and lower concept claims that are likely to be implementable in the future.
